San
Diego, CA - According
to the Orange County Register, a dump-truck driver
and his employer have filed claims against the cities of Anaheim, Orange
and Brea, as well as Orange County and the Department of Transportation,
saying they are responsible for an accident in which the driver crashed
and seven people were injured, one fatally.
Police reports say the
driver was under the influence of methamphetamine, was
driving a truck with faulty breaks and ran a red light. The
driver and his employer, however,
claim the various municipalities were negligent for "not protecting
the public from truck traffic along the steep intersection of Imperial
Highway in Anaheim Hills."
"This is where the
personal responsibility rubber meets the road," said Andy Kotner,
President of San Diego County Citizens Against Lawsuit Abuse (CALA).
"Pointing fingers and suing our communities takes money right out of
the taxpayers' pockets. It's plain and simple highway
robbery."
Separate claims filed
by the truck driver and his employer also blame the location
of the traffic signal and the lack of signs on the hill.
"It's sad to know
that when our municipalities come under the attack of these kinds of
lawsuits, the people end up paying for it," said Kotner. "The
resources and money invested in fighting these suits could be going to
fund education, law enforcement and other valuable programs."
