CALA NAMES "LOONEY LAWSUIT OF THE MONTH" FOR AUGUST

You could get burned if you neglect breakfast


San Diego, CA -  We have all heard warnings that missing breakfast, the most important meal of the day, can be detrimental to your health. A New Jersey couple has found that preparing breakfast can be just as dangerous.

According to Reuters News, a couple in New Jersey is suing the Kellogg Co. as well as appliance maker, Black & Decker Corp., alleging that a cherry Pop-Tart they put in their toaster blew up and burned down their house.

"Just as you would not leave something cooking on the stove unattended, the same applies to heating food in a toaster," said Andy Kotner, President of San Diego County Citizens Against Lawsuit Abuse (CALA). "These types of frivolous lawsuits make it easy for us to ignore our own personal responsibility and start pointing fingers every time something unpleasant happens in our lives."

Brenda Hurff of Washington Township put the pop-tart in the toaster and left the house to pick up her children from school. She returned home to a smoking kitchen. The local fire company listed the cause of the fire as "unattended food."

"Frivolous lawsuits not only increases the burden on our courts, but they teach our children that it's okay to sue at the drop of hat, even when we are at fault," said Kotner. "The fact that this lawsuit has been pursued this far tells us that personal responsibility is being undermined in our society."

The lawsuit is seeking $100,000 for damages caused to their home by the alleged pop-tart "blowtorch."

CALA is a nonprofit, grassroots organization dedicated to educating consumers on the human and financial costs incurred when the legal system is abused for greed, harassment or publicity. More than 8,000 San Diego County residents are CALA supporters.
