CALA NAMES "LOONEY LAWSUIT OF THE MONTH" FOR MAY
Not tonight honey, I have a burnt chin.


San Diego, CA -  A woman in Tennessee claimed she received a burnt chin from a hamburger pickle and her husband claimed he received less than he would have liked in the bedroom because of it. Both sued and got what they deserved - nothing.

According to the Associated Press, Veronica M. Martin has settled her lawsuit against McDonald's, over her claim that a hamburger pickle permanently scarred her chin. Her husband was also a plaintiff in the lawsuit, in which he sought $15,000 for "losing the services and consortium of his wife."

"First it was coffee and now it's a pickle!," said Andy Kotner, President of San Diego County Citizens Against Lawsuit Abuse (CALA). "In this sue happy society, McDonald's is essentially being kicked in the teeth for its patron's inability to eat with common sense, and what ensues are laughable lawsuits."

In 1994, a lawsuit was filed in which a New Mexico woman spilled McDonald's coffee on herself and sued, winning an award of $2.7 million.

Martin's lawsuit sought $110,000, which contended that the pickle was defective and unreasonably dangerous to the customer, breaching an implied warranty for safety. According to a spokeswoman for the fast food chain, McDonald's admitted to no wrongdoing and did not pay the plaintiffs a penny.

Kotner points out that although the plaintiffs were not financially compensated, McDonalds did incur costs infighting and settling the lawsuit.  These costs are typically passed on to consumers.

CALA is a nonprofit, grassroots organization dedicated to educating consumers on the human and financial costs incurred when the legal system is abused for greed, harassment or publicity. More than 8,000 San Diego County residents are CALA supporters.
